This tragic Kentucky auto accident occurred Wednesday evening around 9:30 p.m. near the Bluegrass Army Depot, which is just east of Richmond. The two cars collided on Irvine Road, Ky. 52. Reports indicate that rain may have been a factor in this deadly crash. This is the first deadly car accident this year in Richmond.

Kimberly Holt, age 50, died at the scene of the accident and Jane French, age 49, died at UK Hospital. Both victims were residents of Madison County, Kentucky.

At present, it is unknown who will be legally at fault for this accident, and even then with weather as a possible factor, coupled with Kentucky law recognizing comparative fault, the families of these two women may end up in a legal battle over which estate is entitled to civil legal damages from this fatal accident. Under Kentucky law, comparative fault recognizes that more than one party, including all parties, can bear some fault for an accident. As such, the particular facts of each case are examined and a percentage of fault can be assigned to each party involved in the accident. This percentage then factors into the calculation of legal damages a person, or in cases of a fatality, the deceased’s estate is entitled to recover under the law. This tragic Kentucky automobile crash happened as 5:30 a.m. Tuesday morning on the US 127 Bypass. A major factor in this accident was extremely thick fog that hampered visibility.

Dylan Tucker was driving his Chevy S10 southbound when Michael Devine turned left off of US 62 into the wrong lane of traffic on the US 127 Bypass. Mr. Devine drove northbound in the southbound lane of the Bypass and hit Mr. Tucker’s vehicle head-on. Emergency crews had to cut/extract each of the men from their vehicles due to the damage and severity of the crash. Both men were taken to University of Kentucky Hospital to be treated for the injuries, which are listed as critical and severe.

This a tragic accident that was not intended, but points to the reality that even when weather such as fog is severe, drivers have to take precautions to avoid accidents and control their vehicles properly, including potentially not driving at all until the weather clears. Even in severe weather, drivers in Kentucky owe a legal duty to others to maintain control of their vehicles, which would include not driving in the wrong lane of traffic. Mr. Tucker was in control of his vehicle, traveling the proper lane of traffic. Mr. Devine was not. Even though Mr. Devine did not intend for this accident to happen, and fog impaired his visibility and judgment, he is still legally responsible for the accident. Mr. Tucker is an innocent party who is suffering, incurring medical bills, and whose future is uncertain at this point. As such, under Kentucky motor vehicle laws, Mr. Devine and his auto insurance carrier should be held legally responsible to Dylan Tucker and his family for the legal damages resulting from this accident, including compensation for their suffering. A Kentucky motorcycle accident near Murray, Kentucky has sent Richard A. Crittendon, age 54, to the hospital with injuries. This accident happened on KY 94 near Eastwood Christian Academy at approximately noon on Monday. Reports indicate that Mr. Crittendon was traveling eastbound on his 1988 Kawasaki motorcycle when a 1999 Toyota van, driven by Ruth Drew, age 44, of Murray, turned into the pathway of Mr. Ctittendon, causing his motorcycle to strike her vehicle and ejecting Mr. Crittendon from his motorcycle. Mr. Crittendon was taken to Murray-Calloway County Hospital to be treated for his injuries.

Mr. Crittendon will be able under Kentucky law to seek civil damages (here is a LINK to further explanation of civil injury damages) related to this motor vehicle crash. Too often drivers do not pay enough attention to motorcyclists on the roadway, and a common cause of motorcycle accidents is when a vehicle turns into the pathway of on-coming paths of motorcycles.

When Kentucky motorcycle accidents occur they usually involve serious injuries to the motorcyclist, as such persons are propelled through the air and land breaking bones and suffering internal injuries. As such, the medical bills can be substantial for these accident victims and often the recovery time is long and work/income is missed. Due to the likelihood that the legal damages suffered by victims of motorcycle crashes will be large, insurance issues become complex and often an experienced attorney is able to seek coverage from other insurance policies, above the coverage afforded by the at-fault driver, to insure that the injury victim is fully compensated for the injury and damages suffered.

Accidents involving semis and tractor-trailer truck are serious legal matters in that often truck driver’s errors and negligence is importantly evidenced by the truck log books, which under federal law can be destroyed every 6 months. As such, people who are injured or the families of people who are killed in these types of accidents need to obtain an attorney immediately in order to have legal steps taken to preserve the evidence from these types of accidents, including the truck log books. Kentucky trucking accidents are often severe in that the size and weight of the vehicles can cause serious accidents and severe injuries. Trucking companies usually carry large insurance policies due to the possible severity if trucking accidents. People who are injured in trucking accidents have a legal right under Kentucky Law to file claims for compensation for these types of accidents. A link to the Ackerson Law Offices website (www.kyfirm.com) has more information on legal damages that injury victims can claim under Kentucky law.

In cases of a death, due to a trucking accident, even one where the victim was a pedestrian or as in Mr. Johnson’s case, outside his vehicle at the time of the collision, are classified as Kentucky Wrongful Death claims (link to Kentucky Wrongful Death Claims). In cases of a wrongful death claim, the family, through legal representation, can establish an Estate through the Probate Court in the County where the deceased resided, and then proceed with legal action against the responsible parties whose actions caused the death. Wrongful death claims can be substantial in the amount of damages that can be claimed, which include a calculation of the deceased lifetime earning capacity from time of death through the average life expectancy of a person in similar situations. Under Kentucky statute, KRS 411.130, the compensation/claim received by the Estate of the deceased is then disbursed to the family of the person killed.
