A three vehicle crash has occurred on U.S. Hwy 60 at Blue Ridge Road, in Livingston County, Kentucky. The crash scene is located near the Livingston Central High School. At least one fatality is reported. Police Accident re-constructionists are working to determine what happened and what the cause of the crash was.

Reports indicate that the crash happened around 5:54 a.m. when a motorist driving west on U.S. 60 and veered into the eastbound lane of traffic, colliding head-on with utility truck driven by Michael W. Wurth, age 52, of Boaz. A third vehicle, unable to avoid the crash scene, struck the vehicle that drifted into the eastbound lane. The third vehicle was driven by Jerrod Jennings, age 27, of Burna. The fatality is listed as the driver of the vehicle that drifted into the eastbound lane, who reportedly died at the scene of the crash.

The legalities of this tragic accident are that, Mr. Wurth may have both a workers compensation claim related to this crash and a possible 3rd party tortfeasor action. Mr. Jennings may have a personal injury claim.

A 16 year old female was walking along Ky 131 near Symsonia Elementary School when she was struck by a vehicle and then struck by a second vehicle. This tragic Kentucky pedestrian auto accident happened Sunday. Initial reports indicate that the teenager was walking along the roadway where there were not sidewalks available to pedestrians, when a vehicle driven by Baleda Johnson, age 49, of Hickory, which was traveling north on Ky 131, attempted to avoid the young girl but hit her as she was walking. Reports further indicate that Ms. Johnson stopped her vehicle to call 911 and render assistance, when the teenage was again struck by another vehicle, driven by Olive Barrett, age 82, of Benton. The teenage has suffered severe injuries and was air lifted to Vanderbilt Medical Center.

However, the law in Kentucky is that motorists owe a duty to pedestrians to be on the look out for them and drive safely around them. This teenage, who was walking along the roadway, had a legal right to do such. Motorists have a legal duty to be in control of their vehicles and mindful of their surroundings, so as to not cause injuries or accidents to others. Additionally, the fact that there are not any sidewalks in the area where the teenage girl was hit further demonstrates that she was justified in walking along the road. Other factors such as the accident scene being near a school and businesses, coupled with reading the posts linked to the news story that indicate that the area is well known for teens walking along the road, indicate that motorists should have a heightened knowledge of the potential for pedestrians and thus be more cautious.

This tragic Kentucky auto accident occurred Wednesday evening around 9:30 p.m. near the Bluegrass Army Depot, which is just east of Richmond. The two cars collided on Irvine Road, Ky. 52. Reports indicate that rain may have been a factor in this deadly crash. This is the first deadly car accident this year in Richmond.

Kimberly Holt, age 50, died at the scene of the accident and Jane French, age 49, died at UK Hospital. Both victims were residents of Madison County, Kentucky.

At present, it is unknown who will be legally at fault for this accident, and even then with weather as a possible factor, coupled with Kentucky law recognizing comparative fault, the families of these two women may end up in a legal battle over which estate is entitled to civil legal damages from this fatal accident. Under Kentucky law, comparative fault recognizes that more than one party, including all parties, can bear some fault for an accident. As such, the particular facts of each case are examined and a percentage of fault can be assigned to each party involved in the accident. This percentage then factors into the calculation of legal damages a person, or in cases of a fatality, the deceased’s estate is entitled to recover under the law. This tragic Kentucky automobile crash happened as 5:30 a.m. Tuesday morning on the US 127 Bypass. A major factor in this accident was extremely thick fog that hampered visibility.

Dylan Tucker was driving his Chevy S10 southbound when Michael Devine turned left off of US 62 into the wrong lane of traffic on the US 127 Bypass. Mr. Devine drove northbound in the southbound lane of the Bypass and hit Mr. Tucker’s vehicle head-on. Emergency crews had to cut/extract each of the men from their vehicles due to the damage and severity of the crash. Both men were taken to University of Kentucky Hospital to be treated for the injuries, which are listed as critical and severe.

This a tragic accident that was not intended, but points to the reality that even when weather such as fog is severe, drivers have to take precautions to avoid accidents and control their vehicles properly, including potentially not driving at all until the weather clears. Even in severe weather, drivers in Kentucky owe a legal duty to others to maintain control of their vehicles, which would include not driving in the wrong lane of traffic. Mr. Tucker was in control of his vehicle, traveling the proper lane of traffic. Mr. Devine was not. Even though Mr. Devine did not intend for this accident to happen, and fog impaired his visibility and judgment, he is still legally responsible for the accident. Mr. Tucker is an innocent party who is suffering, incurring medical bills, and whose future is uncertain at this point. As such, under Kentucky motor vehicle laws, Mr. Devine and his auto insurance carrier should be held legally responsible to Dylan Tucker and his family for the legal damages resulting from this accident, including compensation for their suffering. A Kentucky motorcycle accident near Murray, Kentucky has sent Richard A. Crittendon, age 54, to the hospital with injuries. This accident happened on KY 94 near Eastwood Christian Academy at approximately noon on Monday. Reports indicate that Mr. Crittendon was traveling eastbound on his 1988 Kawasaki motorcycle when a 1999 Toyota van, driven by Ruth Drew, age 44, of Murray, turned into the pathway of Mr. Ctittendon, causing his motorcycle to strike her vehicle and ejecting Mr. Crittendon from his motorcycle. Mr. Crittendon was taken to Murray-Calloway County Hospital to be treated for his injuries.

Mr. Crittendon will be able under Kentucky law to seek civil damages (here is a LINK to further explanation of civil injury damages) related to this motor vehicle crash. Too often drivers do not pay enough attention to motorcyclists on the roadway, and a common cause of motorcycle accidents is when a vehicle turns into the pathway of on-coming paths of motorcycles.

This car wreck happened at 1:00 a.m. Sunday morning, when Ricardo Ramos, age 20, which is below the minimum drinking age for Kentucky, pulled off of St. John Drive, in McCracken County, onto US Hwy 45. In doing so, Mr. Ramos pulled into the pathway of Sandra Macias, age 25, and caused this wreck. Mr. Ramos failed to yield the right-of-way to Ms. Macias. Both Ramos and Macias were taken to the hospital for their injuries, where it was determined that Mr. Ramos had been under the influence of alcohol when the accident happened. He has since been criminally charged. In addition to criminal charges, Mr. Ramos and his insurance company can be civilly liable for the legal damages suffered by Ms. Macias from this accident.

A single vehicle Kentucky motorvehicle crash Sunday morning on Purchase Parkway in Graves County, near mile marker 29. Reports indicate that the crash happened around 2:45 a.m. when a vehicle driven by Maranda Helsley, age 21, hydroplaned, left the roadway, and hit a tree. Ms. Helsley and the passenger in her vehicle, Andrea Ribelin, age 20, were both taken to Jackson Purchase Medical center to be treated for their injuries.

Both the Driver and the passenger of this single vehicle crash will be afforded PIP insurance coverage under the policy that insures the vehicle. PIP coverage is also known as Kentucky No Fault Coverage, wherein under Kentucky law, at least $10,000.00 in coverage is afforded to each person in the vehicle. Ms. Ribelin, as a passenger will also be able to make a claim against the insurance bodily injury portion of the policy, as she was a passenger and under Kentucky law the driver had a duty to the passenger to maintain the vehicle in safe operating condition and control, regardless of the excessive water on the roadway which caused the vehicle to hydroplane. A 16 year old driver in McCracken County, Kentucky failed to stop at a stop sign and caused a serious accident on Saturday. The crash happened at approximately 3:00 p.m. at the corner of Oaks road and Sheehan Bridge Road, when the teen driver failed to stop at the stop in the intersection. The teens vehicle collided with a vehicle driven by Mark Mahan, age 49, of Symsonia, and caused serious injury to Mr. Mahan’s passenger, Stephanie Mahan, age 43.

Driver error on the part of the teenager, apparently not paying attention to the roadway and her driving, appears to be the cause of this accident. As such, Stephanie Mahan, will be able to seek legal compensation for her medical bills incurred, pain and suffering, and other out of pocket expenses related to this accident.

This Kentucky car crash involved a vehicle driven by a Harrodsburg, Kentucky man and a Dodge driven by a Greenfield, Indiana man. The accident happened around 1:30 p.m. Saturday afternoon when Paul Murray, age 19, attempted to pass a vehicle in a no passing zone at the junction of US 127 and Ky 906, nine miles north of Liberty, Kentucky. Earnest D. Gilbert, age 59, was driving a 2003 Dodge and attempting to make a left turn onto Ky 906 when Murray’s vehicle collided with Gilbert’s vehicle. Mr. Gilbert was flown to Ephraim McDowell Hospital in Danville, Kentucky to be treated for his injuries. One of Mr. Gilbert’s passengers, Jerri Gilbert, was also transported to the same hospital with injuries.

Both Earnest Gilbert and Jerri Gilbert have Kentucky Personal Injury claims against Mr. Murray and the insurance company insuring his vehicle. Damon McClain, age 40, of Louisville, Kentucky was killed in a moped crash that occurred at the intersection of Dale Ray and Rangeland Road, in Louisville, Kentucky. The accident occurred shortly before 2 pm when a Toyota Camry turned left from Dale Ray onto Rangeland Road directly into the path of the moped. Mr. McClain’s cause of death has been ruled to be multiple blunt force trauma from the crash.

Moped are not different from bicycles, motorcycles or cars. Drivers owe a duty to moped riders to be watchful of their use of the roadways, and afford them the same right-of-way privileges that would be afforded to any other vehicle. All reports would indicate the driver of the Camry was not paying attention or was in a hurry, and thus failed to afford the right-of-way.
